The Distinction That Costs Real Money If You Get It Wrong

The terms "biodegradable" and "compostable" are used interchangeably in packaging marketing every day. Using the wrong one on your food packaging can violate EU and US labeling laws, trigger retailer delisting from sustainability programs, and expose your brand to formal greenwashing accusations that damage consumer trust — and increasingly attract regulatory enforcement. The distinction is not semantic. It is regulatory, and it has direct commercial and legal consequences.

What "Biodegradable" Actually Means — And Why It's Problematic

Biodegradable means a material can be broken down by microorganisms (bacteria, fungi) into water, CO₂, and biomass. The critical problem: the definition specifies no timeline and no environmental conditions. A conventional PET plastic bottle may biodegrade over approximately 450 years in a landfill environment — and legally, in most jurisdictions, it still qualifies as "biodegradable" because the term carries no standardized certification requirement, no mandatory testing protocol, and no enforcement mechanism. This regulatory vacuum is exactly why the EU's Single-Use Plastics Directive and the new PPWR (Regulation 2025/40) effectively ban unqualified "biodegradable" claims on packaging placed on the EU market. The US FTC Green Guides technically require qualification — you must specify the environment and timeframe — but enforcement is complaint-driven and inconsistent. The practical commercial reality in 2026: do not use "biodegradable" as a claim on food packaging. It exposes you to regulatory risk without adding credible marketing value. If your packaging is genuinely compostable, use the specific certified term. If it's not certified, do not make any biodegradability claim.

What "Compostable" Actually Means — Backed by Enforceable Standards

Compostable means the material breaks down into non-toxic organic matter within a specific, defined timeframe under specific, defined environmental conditions — and this is backed by third-party certifiable, auditable, enforceable standards:

  • EN 13432 (EU): ≥90% biodegradation within 180 days in an industrial composting facility at 58±2°C. Must disintegrate within 12 weeks (no visible fragments >2mm). No toxic residue, no adverse effects on compost quality, no negative effects on plant growth. This is the legal requirement for any "compostable" claim on EU-market packaging.
  • ASTM D6400 / D6868 (US): Equivalent North American standards for industrial compostability. BPI certification confirms compliance. Required for "compostable" claims in US and Canadian markets.
  • OK Compost Home (TÜV Austria): The highest eco-credential. Backyard compostable at ambient temperature — no industrial facility required. Decomposition takes 6–12 months. Much harder to achieve than industrial compost certification.
  • ISO 17088: International standard harmonizing the above — increasingly referenced in global supply contracts and corporate procurement specifications.
